Concept and Nature of Employment Contracts
An employment contract is an agreement of wills between a company and an employee. The employee undertakes to personally provide services for the company in exchange for payment, while acting under the company's direction and transferring the results of their activity from the outset.
The company acquires the fruits or results produced by the worker immediately, without waiting for the task to be completed.
The existence of an employment contract is not optional. If an employee provides results to an employer and acts under their direction, an employment contract exists by law.
A common illegal practice involves avoiding employment contracts by signing civil or commercial agreements, forcing employees to register as autonomous workers (False Self-Employment).
Nature of the Employment Contract
- Consensual: Established when both parties provide effective consent.
- Bilateral: Generates obligations for both parties.
- Onerous: Obligations are proprietary in nature, such as the payment of wages.
- Successive: The contract is not extinguished upon the completion of individual tasks.
- Regulated: The free will of the parties is subject to minimum standards established by labor laws and conventions.
Essential Elements of a Work Contract
A valid contract must meet three requirements:
- Agreement: Validly expressed consent between the employer and employee.
- Subject Matter: The content of the service provided and the corresponding salary.
- Cause: The immediate purpose of the contract, specifically the employer's receipt of benefits and the employee's receipt of salary.
Employment Regulations for Minors
In the Spanish state, emancipated minors from the age of 16 may join the workforce. Unemancipated minors require the intervention of a parent or guardian to legitimize the contract, though they do not require permission to work itself.
Restrictions for Minors
- Cannot work overtime.
- Cannot work during night hours (00:00 to 06:00).
- Cannot perform unhealthy, unsafe, or dangerous tasks.
Individuals under 16 cannot work, with the exception of public performances, which require prior authorization from labor authorities.
