Types of Employment Contracts

1. Work Experience Contract

  • Purpose: To provide professional practice appropriate to the level of accredited studies.
  • Requirements: Degree, diploma, or technical qualification.
  • Duration: Minimum 6 months, maximum 2 years.
  • Working Hours: Full-time or part-time.
  • Remuneration: Stipulated by the collective agreement.

2. Interim Contract

  • Purpose: To replace a worker with the right to retain their job or to fill a position during a selection process.
  • Form: Must be in writing.
  • Functions: Can perform the functions of the replaced worker or other duties.
  • Duration: Until the replaced person returns.
  • Working Hours: Full-time or part-time.

3. Specific Project or Service Contract

  • Purpose: To perform a task or service with its own substance, independent of the company's normal activity.
  • Form: Written, with precise indications regarding the work or service.
  • Duration: Limited in time, though the exact duration is uncertain.

4. Production Circumstances Contract

  • Purpose: To address tasks, over-ordering, etc.
  • Form: If exceeding 4 weeks, it must be in writing.
  • Duration: 6 months within a 12-month period (or up to 12 months within an 18-month period).
  • Working Hours: Full-time or part-time.
  • Note: If formalized through a temporary employment agency, compensation is higher (12 days).

5. Part-Time Contract

  • Concept: Working hours per day, week, month, or year that are less than a comparable full-time worker.
  • Form: Must be in writing, specifying hours and distribution.
  • Duration: Indefinite or temporary.
  • Overtime: Allowed only if in writing; cannot exceed 15% of ordinary hours or 60% of total hours.
  • Resignation: Requires 15 days' notice if employed for more than a year.

6. Discontinuous Permanent Contract

  • A specific mode of part-time, permanent contract that must be in writing.

Employer Obligations

  • Documentation: 4 copies must be created (Employee, Employer, Public Employment Service, and Legal Representatives).
  • Registration: Must register with the Public Employment Service within 10 days.
  • Representation: Staff representatives are named for workplaces with up to 49 workers; a business committee is required for 50 or more workers.
  • Legal Presumption: If a contract is not formalized in writing, it is presumed to be a permanent, full-time contract unless the employer can prove the temporary or part-time nature of the relationship.
