Defining Public Spectacles
A public spectacle is an event organized to gather the general public for activities or displays of a cultural or artistic nature.
Defining Recreational Activities
Recreational activities are those intended for the general public, focused on recreation, leisure, and amusement.
Local Licenses for Public Establishments (EEPP)
These licenses are local priorities for establishments hosting Public Spectacles and Recreational Activities (EEPP).
Types of EEPP Licenses
New Construction License
Required for any new building intended for EEPP. A license must be requested from the City Council (Ayto.). The applicant must secure civil and fire liability obligations and have an emergency plan.
Adaptation or Renovation License
For constructions that will undergo an alteration in their structure or a change in their use for public shows.
Operating License Requirements
City Councils (Aytos.) are obligated to verify that installations conform to the submitted project. This check must be completed within a maximum of one month after the completion of works. After this period, the holder may commence business operations following communication to the City Council. Within 5 days from the granting of the operating license, the Autonomous Community (CM) City Councils must send a copy of the license and the technical report.
Interim Operating Licenses
Issued when the result of the administrative inspection is unfavorable.
Special Licenses for Historic Buildings
Required if the building has cultural or historic value. A favorable opinion from the Autonomous Community (CM) is necessary.
Special Alcoholic Beverage Sales Licenses
According to Article 5/2002, for premises that serve alcohol.
Prohibited Activities and Conduct
The following activities are prohibited and criminalized:
- Inciting or promoting violence, racism, or actions that offend human dignity.
- Cruelty or mistreatment of animals.
Areas of Police Intervention and Oversight
Police intervention may address various aspects, including:
- Aspects related to health.
- Fiscal aspects.
- Aspects related to consumption and users.
- Aspects related to the environment.
- Aspects related to state-level legislation.
- Criminal aspects (Autonomous Community jurisdiction).
Regulations for Alarm Systems
Authorization from the City Council (Ayto.) is required for alarm systems. Specific regulations include:
- Tests must be conducted between 9 AM and 10 PM.
- The maximum continuous duration of a demonstration signal is 60 seconds.
- A signal may be repeated a maximum of 5 times, spaced 30 to 60 seconds apart.
- The maximum sound level is 86 dBA, measured at 3 meters.
Pet Owner Responsibilities
Pet owners have specific obligations:
- Take measures to prevent discomfort to people.
- Indoors, where loose dogs are present, there is a duty to visibly warn of their presence.
- Secure civil liability insurance.
Prohibited Animal Practices
The following practices related to animals are prohibited:
- Mistreatment.
- Abandonment.
- Mutilation practices.
- Neglecting to feed animals.
- Keeping animals for street vending or peddling.
- Keeping animals on terraced patios at night if they disturb neighbors.
- Failure to implement animal control measures.
- Allowing animals entry into children's play areas.
- Having more than 5 dogs and cats in the same household without permission.
