Limits on Religious Freedom
The exercise of religious freedom is not absolute and is subject to specific legal constraints.
Article 3.1 LOLR: Fundamental Rights and Liberties
- Protection of others: The exercise of religious freedom must respect the fundamental rights and liberties of others (Articles 15-29 of the Spanish Constitution).
- Public Policy: Protected by law (Articles 16.1 and 10 EC), public policy acts as a guarantor of the legal system. It is interpreted narrowly and positively, focusing on the protection of individual development rather than mere restriction. Any limitation must be clearly motivated.
International Standards
International frameworks establish public order as a legitimate limit to fundamental rights, including:
- Universal Declaration of Human Rights
- International Covenant on Civil and Political Rights
- Treaty of Rome
State-Mandated Limitations
The State ensures the protection of citizens through the following boundaries:
Public Health
Mandatory measures, such as vaccinations to prevent epidemics, take precedence over religious objections to ensure the health of the community.
Private Health
In cases such as Jehovah's Witnesses refusing blood transfusions, the law prioritizes the health of third parties. Regarding minors, the Law of Patient Autonomy and Constitutional Court rulings dictate that medical decisions are based on the minor's maturity.
Public Safety
The State is responsible for maintaining a stable environment that allows for the development of fundamental rights.
Public Morality
Defined by the evolving criteria of societal groups, though the State must remain neutral in accordance with the principle of secularity.
Proportionality and Legality
Any interference with religious freedom must be:
- Proportionate: It must not distort the core content of the right.
- Legitimate: It must be clearly defined by law so that it is transparent and accessible to all citizens.
