Non-Contributory Disability Pensions

The non-contributory disability pension is intended for individuals with permanent physical or psychic deficiencies, whether congenital or acquired, that limit their sensory, motor, or mental capacity.

Eligibility Requirements

  • Age: Must be at least 18 and under 65 years old at the time of application.
  • Residency: Must legally reside in Spanish territory for at least 5 years, including the two years immediately preceding the application.
  • Disability: Must be affected by a disability or chronic illness with a degree of 65% or higher.
  • Income: Must lack sufficient income or resources.

Income Limits

The income requirement is calculated annually (January to December):

  • General Limit: For individuals not belonging to a family unit, income must not exceed the annual non-contributory pension amount (set at €4,598.16 for 2008).
  • Special Limit (Family Unit): For those living with relatives by blood, marriage, or adoption (up to the second degree):
    • General Case: The limit is the pension amount plus 70% of that figure multiplied by the number of additional household members.
    • Vertical/First-Degree Unit: If living with ascendants or descendants of the first degree, the limit is doubled.

Pension Amount

The pension is paid in 14 annual installments. As of 2008, the monthly amount is €328.44.

Non-Contributory Retirement Pensions

The right to a non-contributory retirement pension is granted to those who meet the following criteria:

  • Age: Must have reached 65 years of age.
  • Residency: Must have legally resided in Spain for 10 years between the age of 16 and the date of the pension application.
  • Income: Must lack sufficient income, interpreted under the same terms as the disability pension.

Additional Benefits

The pension amount is set by the General State Budget (LPGE) at the same level as the disability pension. Additionally, per RD 1400/2007, holders of non-contributory pensions who live in rented accommodation may be eligible for a supplement of €350 per month.
