Crimes Against the Person: Common Law Definitions

• Assault: A threat or attempt to commit a battery.
• Battery: The use of force against another resulting in harmful or offensive contact.
• Mayhem: Maliciously depriving another of the use of a limb (disablement) or injuring the victim to permanently change their appearance (disfigurement).
• Rape and Related Offences: Unlawful sexual intercourse with a female without her consent. Modern statutes often designate this as sexual assault. Statutory rape applies if the female is too young to give consent.
• False Imprisonment: The intentional, unlawful confinement of another person. The victim must be compelled by the defendant's use of force or threat to remain or go somewhere against their will.
• Kidnapping: The forcible abduction or stealing away of a person from their country and sending them into another.

Delitos Contra la Persona: Definiciones Legales

• Amenaza (Assault): Consiste en dar a entender, con actos o palabras, que se quiere hacer algún mal a otro.
• Violencia con Lesiones Físicas (Battery): Daño o detrimento corporal causado por una herida, golpe o enfermedad. Se castiga a quien cause daño en el cuerpo o salud de otro. Dependiendo de la intención, el delito puede ser doloso o culposo.
• Lesiones Permanentes o Graves (Mayhem):
  • Lesiones Graves: Producen una debilitación permanente en la salud, un sentido, un miembro o un órgano.
  • Lesiones Gravísimas: Dejan una enfermedad mental o corporal incurable, invalidez permanente para el trabajo, o la pérdida de un sentido, órgano, miembro, uso de la palabra o capacidad de engendrar.
• Violación (Rape): Acceso carnal con una mujer privada de sentido, empleando fuerza o grave intimidación. Si la mujer es menor de edad, el delito se clasifica como estupro.
• Privación Ilegítima de la Libertad (False Imprisonment): Sustracción, retención y ocultamiento de una persona para obligar a la víctima o a un tercero a actuar en contra de su libertad.
• Secuestro (Kidnapping): Aprehender ilícita e indebidamente a una persona para exigir dinero por su rescate o para otros fines.
