Competencies of Staff Delegates and Committee Members

Staff delegates and committee members possess the following business skills and rights:

Information Rights

Receive information regarding:

  1. The economic situation of the company and the sector it belongs to.
  2. The probable evolution of employment within the company.
  3. The company's accounts.
  4. All penalties imposed for offenses deemed very serious.
  5. The staff absenteeism index and its causes.
  6. Indices of occupational accidents and diseases and their consequences; accident rates.
  7. Periodic or special studies on the working environment and the prevention mechanisms that are used.

Contractual Matters

  • Receive a basic copy of contracts and notification of extensions within ten days.
  • Know the models of written work contracts used in the company, as well as documents relating to the termination of the employment relationship.

Consultation Rights

Issue a report before the employer implements decisions concerning:

  • Redundancies, dismissals, or suspensions.
  • Reduced contractual working hours.
  • Total or partial transfer of facilities.
  • The company's vocational training plans.
  • Implementation or revision of work organization and control systems.
  • Time studies, bonus and incentive systems, and job evaluations.

Monitoring Responsibilities

  • Monitor compliance with existing rules on labor, social security, and employment.
  • Monitor and control health and safety conditions in the workplace.

Election Politics and Procedures

Workers' representatives are elected through free, direct, secret, and personal elections. The term of office shall be four years, understood to be extended if new elections are not promoted.

New elections can be called not only by trade unions but also by the workers in the workplace, based on a majority agreement established in an assembly record.

Voter Eligibility

Who can vote?

  • Individuals over 16 years old.
  • Must have seniority in the company of at least one month.
  • Foreigners who meet the requirements for Spanish workers may also vote.
  • Eligible workers include fixed-term discontinuous workers and workers with temporary contracts.

Election Procedure

Election of Delegates

For the election of delegates, each elector can vote for as many candidates as there are positions to fill. Those candidates who receive the most votes are elected.

Election of Committee Members

For the election of committee members, the census of eligible voters is divided into two colleges:

  1. College 1: Composed of technicians and administrative staff.
  2. College 2: Composed of specialists and unskilled workers.

Each voter votes for a list of candidates, not for individual candidates.
