Article 58: Property Transfer Registration
To register the transfer contract inter vivos, gift, or an estate that has not previously been registered, the Keeper will require evidence of having given notice of such transfer to the public through three advertisements in a newspaper. This notice must be placed in the department or the capital of the province (if there isn't a newspaper in that department). A sign must also be set for at least fifteen days in the office of the Conservative, with the designations of persons transferring the property, and the boundaries and name of the property, which is the subject of the contract.
The Conservative will certify compliance with the requirements indicated in the preceding paragraph at the foot of the document and proceed to formally sign it.
The same rules of registration or incorporation apply to the registration of transfer acts between living persons and the rights of usufruct, use, room, census, and mortgage relating to property not registered.
Registration cannot be made but once within thirty days from the issuance of the certificate referred to in subsection two.
Article 52: Conservatory Registration Requirements
The following must be registered in the Conservatory:
- The titles of the domain translaticios real estate; the titles of usufruct, use, room, census, and real estate mortgages; and the final sentence stating the prescription purchasing the domain or of any such rights. Regarding the registration of titles relating to mines, it will be prevented in the Mining Code.
- The constitution of trusts that understand or affect real estate, the usufruct, room use and to be borne by property inter vivos, the constitution, division, reduction, and redemption of the census, the Census constitution for life, and the creation of the mortgage. The rules relating to mortgage of ships belong to the Commercial Code.
- The waiver of any rights listed above.
- The temporary ban and decrees. Ultimately, the sink and rehabilitation demented, confirming the final possession of the assets of the deceased and to give the benefit of separation of property under section 1385 of the Civil Code.
