Article 45: Very Serious Offenses
- Breach of fiduciary duty to the Constitution: Conduct constituting an intentional crime.
- Abuse of authority: Practice of inhuman, degrading, or discriminatory treatment during custody.
- Insubordination: Individual or collective insubordination and disobedience to lawful instructions.
- Failure to provide urgent assistance.
- Abandonment of service.
- Violation of professional secrecy: Failure to disclose matters known by virtue of office, which disrupts police work or personal privacy.
- Breach of impartiality: Discriminatory action based on social status.
- Incompatible activities: Exercise of public or private activities incompatible with service, participation in strikes, or similar actions intended to disrupt normal service operations.
- Lack of cooperation with FCS (Security Forces and Corps).
- Intoxication: Getting drunk or using toxic drugs during service or habitually.
Article 46: Serious Misdemeanors
- Disobedience to superiors: Breach of orders, if not classified as a very serious offense.
- Lack of respect: Manifest and serious disregard for superiors, peers, or subordinates.
- Prejudicial conduct: Acts and conduct prejudicial to the dignity, image, or prestige of the Corporation.
- Damage to property: Causing, by malice or gross negligence, damage to the property and assets of the Corporation.
- Instigating fights: Origination or participation in fights during service.
- Failure to report: Breach of the obligation to report to superiors on matters requiring their knowledge or urgent decision.
- Refusal of tests: Refusal to undergo relevant technical tests or exceeding a blood alcohol level of 0.3 during service.
- Improper equipment handling: Failure to properly carry credentials, insignia of rank or position, weapon, or means of protection during service, or their inexcusable loss or theft due to negligence.
- Repeated unexcused absence: A third unexcused absence within a three-month period, when the previous two absences resulted in penalties for minor infractions.
- Recidivism: Repeated commission of serious misdemeanors.
- Feigning illness: Simulating a more severe illness or feigning illness to avoid providing service.
Article 47: Minor Misdemeanors
- Impropriety: Towards superiors, peers, or subordinates.
- Negligence in duties: Delay, negligence, or neglect in the performance of functions or received orders without just cause.
- Neglect of appearance: Neglect of personal appearance.
- Unexcused absence: Absence from work for a full day without just cause.
- Profiteering from swaps: Application for or achievement of service swaps or exchanges for personal profit.
- Regulatory non-compliance: Failure to adhere to regulatory procedures.
- Punctuality failures: Repeated failures of punctuality within the same month without just cause.
- Single unexcused absence: A single unexcused absence for a full day.
