Duties of Users
Article 15. Users are obligated to comply with regulations governing land transportation and must pay the corresponding compensation, if applicable, for the use of specific track sections.
Enforcement Bodies
Article 18. For the purposes of this Act, the enforcement bodies and authorities responsible for verifying the control of National Land Transport are:
- The Technical Monitoring of Land Transport: Under the supervision and assignment of the National Institute of Land Transportation.
- Approved Police Forces: National, municipal, and state police duly approved to perform control functions regarding land transport operations.
- The National Armed Forces: Authorized to act as executors of this Act, without prejudice to the functions conducted by the aforementioned police and enforcement agencies.
Police Approval and Jurisdiction
Article 20. Police forces are responsible for the control and monitoring of transit on roads within their respective jurisdictions, excluding national roads. They may assume control of roads within their jurisdiction by applying national legislation.
Police forces may manage the removal of traffic accidents involving property damage, provided officials are accredited by the National Institute of Land Transport in accordance with this Act's regulations.
Actions taken by police who have not been approved in accordance with this article are null and void.
National Institute of Land Transport
Article 22. The National Institute of Land Transport is a body under the Ministry of Popular Power qualified in the field of land transport. It possesses legal personality, enjoys the privileges and prerogatives granted to the Republic by law, and is based in Caracas, though it may establish offices in any other region of the country.
The National Institute of Land Transportation shall establish regional offices to optimize the ground transportation services it provides.
Sole Paragraph: The National Institute of Land Transport shall be part of the National Civil Protection System, ensuring the integration, articulation, and coordination of prevention and care among National, state, and municipal Public Power organs upon the occurrence of adverse events arising from land traffic accidents.
