Municipio Local Government and State

The Municipio: Regulated in art. 140 Cst., which states that the Constitution guarantees the autonomy of municipalities.

  • Municipal area: It is the territory in which the municipality exercises its powers.
  • Municipal population: It comprises all persons who are in the township, who are divided into Spanish residents and nonresidents.

City Organization and Organs

Organization (City): The necessary organs are the mayor, deputy mayors, full council and the Local Government Committee.

Complementary bodies: Councilors and Delegates.

Mayor: Election and Role

Mayor: Single judge presiding the Corporación. The mayor is elected by the council; among all candidates, the one with an absolute majority of votes will be proclaimed. The mayor can be removed from office by a vote of censure.

Powers of the Mayor

Powers of Mayor: Represent the City Council; direct the Government and the Municipal Administration; convene and preside over plenary sessions; issue bandos; approve public jobs; develop economic management; contract public works; and oversee the Municipal Police Headquarters.

Deputy Mayor

Deputy Mayor: They are appointed by the mayor and replace the mayor in cases of absence, illness, etc.

Municipal Authority and Council

The Municipal: Municipal authority consisting of all council members and chaired by the mayor. The number of councilors will be elected by each municipality based on the population of the municipality.

Full Powers of the Council

The full powers are:

  • To elect and dismiss the mayor.
  • To control municipal governing bodies.
  • To approve the rules and bylaws.
  • To approve the staff.
  • To adopt and amend budgets.

Committees, Complaints and Representatives

(County) 1 C Special omission, suggestions and complaints: It is created by the full council for neighbors to defend against or address issues with the city administration.

Special Committee on Accounts: It is for the study and report of all accounts to be adopted by the plenary.

Complementary Organs: Aldermen and Delegates

2 Organs complementary Aldermen Delegates: They deal with a particular subject or field of activity (culture, safety, environment).

Informational Committees: Their role is to study and report on the matters that will be decided in plenary.

Personal Representatives: The mayor may appoint a representative body of neighbors in each of the towns and neighborhoods separated from the inner city.

Municipal Utility Services

Municipal utilities services: The municipalities must provide a mandatory minimum number of services depending on the population, established as follows:

  1. In all municipalities: Street lighting, cemetery, waste collection, cleaning, water and sewerage.
  2. In municipalities with more than 5,000 inhabitants: In addition to the above, public parks, library, market and waste treatment.
  3. In towns over 20,000 inhabitants: In addition to the above, civil protection, social services, fire prevention, sports facilities and slaughterhouse.
  4. In towns over 50,000 inhabitants: In addition to the above, urban transportation and environmental protection.
