Permanent Employment Contracts
Indefinite Contracts: These are contracts without a certain completion date. They are presumed to be held indefinitely unless proven otherwise.
Promotion of Permanent Contracts
Purpose: To facilitate the placement of groups affected by unemployment, including:
- Workers over 45 years of age.
- Individuals registered for at least one month with the public employment office.
- Disabled workers.
Fixed-Term Contracts
Fixed-term contracts must have a fixed end date. The Labor Statute outlines specific circumstances for their use.
Contract for Specific Work or Service
- Purpose: To carry out specific works or services.
- Duration: Determined by the time required to perform the work or service.
- Notice: If the duration exceeds one year, 15 days' notice is required.
- Compensation: 8 days of salary per year worked, prorating for shorter periods.
Interim Agreement (Substitution Contract)
- Objective: To replace workers who are temporarily absent or filling a position during a selection or promotion process.
- Duration: The time required for the substitution. If used for selection or promotion processes, the maximum duration is three months.
Insertion Contract
Designed for unemployed individuals registered with employment offices to participate in public programs involving the execution of works and services of general and social interest.
Internship Contract
- Objective: To facilitate the inclusion of young people who hold a qualification but lack professional work experience.
- Requirement: Must demonstrate a correlation between the work performed and the level of studies completed.
- Duration: Six months minimum to two years maximum.
- Working Hours: Can be full-time or part-time.
- Salary: Must not be less than the minimum wage proportional to their working day.
Training Contract
- Objective: To acquire specific theoretical and practical training relevant to the job.
- Requirements: Must be over 16 and under 21 years of age, and must not hold a relevant degree or qualification for the position.
Part-Time Contracts
Part-time contracts are designed to enable access to work when the services required are less than the standard working time of a full-time employee.
- The contract must clearly state the number of hours and their distribution (schedule).
- Social Security (SS) contributions are calculated based on the compensation actually received.
- Duration is typically determined, subject to specific regulations.
Relief Contract (Contract Release)
Purpose: To hire an unemployed worker to replace an employee who reduces their working time and salary in order to transition into partial retirement.
Other Forms of Recruitment
Anticipated Replacement Contract
- Duration: Minimum one year.
- Allows for the replacement of a worker up to one year prior to their planned retirement date.
Contract for Work at Home
Work performed by the employee primarily at their own home or a location freely chosen by them.
Contract for Work Groups
This contract involves the figure of the group leader, who is accountable to the collective group of workers.
Contract for Victims of Domestic Violence
Specific contract provisions apply to workers who have proven to be victims of domestic violence.
