Summary of Offenses and Disciplinary Actions

Article 108: Very Serious Offenses

  • Participating in riots, collective disturbances, or inciting them if they have occurred.
  • Assaulting, threatening, or coercing any person within the establishment, or authorities, judicial, or penal institution personnel. This includes actions both inside and outside the establishment if the inmate was out for a legitimate reason, and applies to those acting in their official capacity or in connection with it.
  • Grave assault or coercion of other inmates.
  • Active and serious resistance to compliance with orders from authority or officers in the lawful exercise of their powers.
  • Attempting, facilitating, or committing evasion (escape).
  • Deliberately disabling units, materials, or effects of the establishment, or property of others, causing significant damage.
  • The removal of materials or property belonging to the establishment or other persons.
  • Dissemination of false news or information with the intention of undermining facility security.
  • Acts gravely offensive to public decency, causing significant scandal.

Article 109: Serious Offenses

  • Slandering, insulting, or seriously disrespecting authorities, officials, and individuals mentioned in paragraph b) of the previous article, under the circumstances and in the locations specified therein.
  • Disobeying orders from authorities or officials in the legitimate exercise of their powers, or passively resisting compliance.
  • Instigating other inmates to riot, disorder, or collective disturbances, even if not assisted by them.
  • Insulting other inmates or mistreatment of fellow inmates.
  • Deliberately disabling units, materials, or effects of the establishment, or property of other persons, causing minor damage; or causing serious property damage through negligence.
  • Introducing, removing, or possessing objects within the establishment that are prohibited by internal regulations.
  • Organizing or participating in games of chance or gambling for stakes, or in unauthorized alternative games on the premises.
  • Dissemination of false news or information with intent to impair the smooth running of the correctional establishment's operations.
  • Intoxication caused by the abuse of authorized alcoholic beverages that seriously interferes with the establishment's operations, or by consuming alcoholic beverages obtained or produced clandestinely; and the use of toxic drugs, psychotropic substances, or narcotics without a prescription.

Article 110: Minor Offenses (Misdemeanors)

  • Slightly lacking due consideration to the authorities, officials, and individuals mentioned in paragraph b) of Article 108, in the circumstances and places therein expressed.
