Understanding Worker Compensation and Wage Structures
The Salary: Economic Benefits for Labor
The salary is the entire economic benefit provided to workers, whether in cash or in kind, for the provision of their labor services. In no case may the wage paid in kind exceed 30% of the worker's total perceptions.
Wage Structure Components
The wage structure includes:
- The base salary rate set per unit of time and work.
- Pay supplements, where appropriate, fixed as a function of personal circumstances, work performed, or working conditions.
Form of Remuneration
Remuneration is classified according to the means of payment:
1. Monetary Remuneration (Dineraria)
Payment made in cash or other accepted means (check, bank transfer, etc.).
2. Remuneration in Kind (En Especie)
Consists of the delivery of certain goods or employee benefits, such as housing, a vehicle, medical insurance, or utility supply. This form may not exceed the established limit.
Minimum Wage (SMI)
The Minimum Wage (SMI) is the minimum amount an employee can receive for working a 40-hour week. This amount can be improved through collective agreements or labor contracts.
When contracted for less than 40 hours per week, the salary will be proportional to the time worked.
The SMI can be increased by complex wage components, such as:
- Extraordinary payments (pagas extraordinarias).
- Job supplements (e.g., seniority/antigüedad).
- Night work (nocturnidad).
- Hazardous or toxic conditions (peligrosidad, toxicidad).
Wage Guarantee Fund (FOGASA)
The Wage Guarantee Fund (FOGASA) ensures the partial or total payment of workers' wages and severance indemnities due to dismissal or extinction of the employment relationship when the employer is insolvent, in suspension of payments, bankruptcy, or creditor proceedings.
FOGASA Payment Limits
Salary Payments
In cases of employer insolvency, the maximum payable amount results from multiplying twice the daily minimum wage by the number of days owed, with a maximum limit of 120 days, excluding extra payments.
Allowances (Indemnities)
For dismissal or contract extinction recognized by judicial or administrative ruling, the limit is one year, based on 25 days per year of service. In calculating the wage for this purpose, twice the interprofessional minimum wage cannot be exceeded.
FOGASA Funding and Payment Schedule
FOGASA contributions are funded by employers through a percentage calculated on the workers' social security contribution base.
Wages are paid monthly, fortnightly, or weekly, according to the custom of each company.
Wage Slip Obligation
Every employer is obliged to provide the worker with a wage slip (nómina) specifying each perception and any deductions made.
Wage Slip Model and Receipt
The model used for the receipt must be consistent with that established by the Ministry for Employment and Social Matters. The employee's signature attests to the receipt of the stated amounts but does not imply conformity with them.
Wage Claim Deadline
The deadline for claiming unpaid wages is one year.
