Statutes of Autonomy: Institutional Norms

The Statute of Autonomy serves as the basic institutional norm for each Autonomous Community. While these statutes share parallels with the Constitution, a fundamental distinction exists: the Constitution is the supreme law, whereas the Statute of Autonomy is subordinate to and derived from it. Like the Constitution, each statute establishes a specific procedure for its own amendment.

Legislative Reform and Approval

Although the Constitution provides various methods for preparing statutes, any reform requires approval via an Organic Law. The relationship between these statutes and other legal frameworks is governed by the principle of competition.

Legal Force of Regional Laws

The concept of autonomy necessitates fundamental equality between state standards and the rules of the Autonomous Communities. There is no essential difference in rank between the state and the communities; rather, there is a separation of powers. In cases where the public interest requires it, courts may harmonize various regional laws. The state may also utilize this mechanism to influence the powers of the Autonomous Communities.

Jurisdiction and Legislative Scope

  • Scope: Regional laws apply only within their respective autonomous territory.
  • Authority: Legislative power is derived directly from the Statute of Autonomy.
  • Jurisdiction: Responsibilities may be exclusive to the community or shared with the state.

When legislation is shared, the state establishes the basic legislation, which the autonomous region then develops. Regional laws must respect these basic state concepts. Furthermore, this legislation cannot strip the Autonomous Communities of their legislative powers. Regional laws are promulgated and published by the President of the Community. Notably, the autonomous government cannot utilize the laws of the courts, and while both parliamentary regulations and legislative decrees hold the force of law, standard decrees are not permitted within the Autonomous Regions.
