Wealth Tax Requirements and Compliance

Management has imposed the requirement to submit a statement of heritage based on the following criteria:

Personal Tax Liability

Natural persons are subject to personal liability if they meet any of the following circumstances:

  • Taxable income exceeds €108,182.18.
  • The value of property and rights exceeds €601,012.10.

The tax liability for any individual must be submitted by each taxpayer. Deadlines align with income tax (IRPF) filings, though the two statements are not presented together. The model used is the D-714, payable at the same locations as IRPF.

Exemptions and Special Assets

Assets belonging to the Spanish Historical Heritage, which are registered in the General Inventory of Personal Property or the General Register of Real Interest Cultural, must be declared regardless of the taxable base amount.

Filing Procedures

  • Submission: Must be filed at the Delegation of the State Agency for Tax Administration corresponding to the taxpayer's fiscal domicile.
  • Simplified Declaration: A simplified declaration (Model 214) is available for Wealth Tax and joint income tax when the estate consists solely of a primary residence.

Residency and Tax Scope

Those with habitual residence in Spanish territory are subject to tax liability. The definition of habitual residence follows IRPF regulations. Residents are taxed on their entire net worth, regardless of where the property is located or where rights are exercised.

When a resident moves to another country, they may choose to continue paying personal liability in Spain for the first year of non-residency.

Real Obligation (Non-Residents)

Individuals who have assets and rights in Spanish territory, regardless of their residency status, are subject to Real Obligation. This also applies to individuals who become tax residents in Spain but opt to be taxed under IRNR rules.

Non-resident taxpayers are required to appoint a representative residing in Spain, unless the tax relates to a single house in Spain designated as an address for notifications. These individuals are taxed only on assets located or rights exercised within Spanish territory.
