Spanish Social Security System
In the Spanish social security system, there are two primary modes for benefit purposes: contributory and non-contributory.
A. Contributory Mode
This mode integrates all workers and their families. Individuals must be included under one of the following categories:
- Employees
- Self-employed workers
- Members of worker cooperatives
- Public officials (civilian and military)
- Non-resident Spanish nationals in specific situations
- Students
- Foreigners with valid residence and work permits in Spain
B. Non-Contributory Mode
This mode includes all Spanish residents who do not qualify for the contributory regime due to insufficient or non-existent contributions. Benefits include:
- Health care
- Disability support
- Retirement pensions
- Dependent child allowances
Social Security Regimes
General Regime: Covers Spanish or foreign nationals engaged in regular paid employment not included in any special regime.
Special Regimes:
- Agricultural workers
- Seafarers
- Coal mining workers
- Self-employed individuals
- Public officials (civilian and military)
- Domestic employees
- Students
- Groups determined by the Ministry of Labor and Social Affairs
Organizational Structure of the SS
Responsibilities for the regulation and control of the Social Security system are attributed to the Ministry of Health and the Ministry of Labor and Social Affairs.
A) Management Entities
- National Institute of Social Security (INSS): Responsible for the management and administration of cash benefits.
- National Institute of Health Management (INGESA): Administers health services.
- Institute for the Elderly and Social Services (IMSERSO): Administers non-contributory disability and retirement benefits, ancillary services for the elderly, and assistance for internal migration and the social integration of refugees.
- Social Marine Institute (ISM): Responsible for the management and administration of benefits within the maritime and fisheries sector.
B) Common Services
- General Treasury of Social Security (TGSS): Unifies all financial resources, manages the custody of funds, assets, and credits, and handles revenue collection and payment of obligations.
- Social Security Informatics (Gerencia de Informática): Manages the computerization and information systems of the Social Security network.
