Legal Requirements for Alimony Debt Enforcement
The following assumptions are required for the occurrence of legal pressures regarding the non-payment of debt:
- 1. Executory Order: Maintenance must have been decreed by an order which is executory or agreed upon in a compromise approved by the court.
- 2. Eligible Beneficiaries: Maintenance must have been granted to one of the following persons: the spouse, parents, children, or adopted individuals. If the recipient is not one of the persons listed above (e.g., siblings or grandparents), then the constraint is not applicable.
- 3. Default on Obligation: The obligor (alimentante) must have defaulted on their obligation, leaving one or more alimony payments unpaid.
- 4. Court Decree: The court must decree the enforcement, which can occur by request or automatically. It should be noted that the pressure should be decreed "without further delay," which means there is no need to hear the obligor to do so.
Arrest and Arraignment for Unjustified Resignation
Finally, Article 14 states that the same constraints apply to those liable to pay maintenance to the persons mentioned above if they terminate their employment by voluntary resignation or mutual agreement with the employer without good cause. This applies after notification of demand and a lack of income that is sufficient to meet the maintenance obligation.
Legal Solidarity in Maintenance Payments
Article 18 of the Act of Abandonment of Family and Alimony states: "They will be jointly responsible for paying the maintenance obligation who cohabits with the parent or spouse obligor, and those who, without the right to do so, would impede or incapacitate the faithful and timely compliance with that obligation."
Compromise on Future Maintenance Payments
Civil Code Section 2451: "The transaction on future maintenance pensions for those who are owed by law shall not be valid without court approval, nor will the judge approve it if it is contrary to the provisions of Articles 334 and 335."
Characteristics of Future Maintenance Transactions
The transaction on future maintenance is subject to the limitations already mentioned:
- 1. Legal Compliance: The transaction must not be contrary to Articles 334 and 335 of the Civil Code.
- 2. Modifiability: The transaction on future maintenance can be modified by the application of Article 332.
- 3. Executive Merit: A court decision approving a transaction in the manner prescribed by law will merit executive action.
- 4. Wage Withholding: In the case of dependent workers who are obligors, unless otherwise stipulated, the judge must order payment via withholding by the employer.
