Trial of Insertion and Rectification Procedures

The game model does not exist. The Trial of Rectification is a special procedure, whereas the Trial of Insertion is a regular procedure.

Special Trial of Rectification

This procedure focuses on data correction involving:

  • 1. False or incorrect information: Erroneous data entered into records.
  • 2. Default: A lack of requirements as mandated by law.
  • 3. Prohibited mentions: Inclusion of information not required by law.

Rectification by material errors: If there is an action that overrides the suit, a trial for rectification is not sought.

Judicial and Extrajudicial Rectification Classes

Adjustments can be categorized into two classes:

1. Judicial Rectification (With Trial)

This occurs when a judge issues an executed sentence and sends it to the register for the placement of the respective footnote in the record.

2. Extrajudicial Rectification (No Trial Required)

This happens without a trial when the official realizes there is an error (misrepresentation, omissions, or prohibited mentions). The correction is made immediately in the presence of all parties, placing the respective notice.

Note: Anyone can request a trial because the state civil rectification is a public matter.

The Nature of the Trial of Insertion

The Trial of Insertion is used to prove a right that you enjoy in fact. This is conducted through a regular (long) trial. The insertion of items is considered more serious than rectification since it assumes a lack of departure or record.

Extra Special Testing Systems

There are two extra special test systems used if a person lacks a birth certificate and intends to marry or obtain a certificate of identity:

  • System Test Extra Special for Marriage: The birth certificate may be supplied by providing reasons through witnesses conducted before a judge.
  • System Test Extra Special for Identity Certificates: This involves submitting an affidavit signed by two relatives who must declare the affiliation, date, and place of birth.

Elements of the Possession of State

The Possession of State is what will be proven in a Trial of Insertion. It is the appearance of being an owner or having a certain marital status. It is only spoken of when there is a major test.

Core Elements

  • 1. Name: Consists of using the name of the person from whom recognition of parenthood is claimed. Remember that the name is the material expression of one's state.
  • 2. Treatment: Being treated in fact within the family circle as the legal owner of the state one claims to have. This includes mutual respect, affection, and consideration between father and son.
  • 3. Fame: Consists of being considered by the public and all persons within family relations as being entitled to that state within their social environment.

Proving one element clearly and concisely will be enough. Characteristics of the Possession of State: It is considered an extra test.
