Human Resources Management: Key Functions and Contracts

The Personnel Function is responsible for managing corporate human resources and encompasses the following core areas:

  • Selection
  • Labor Relations
  • Training
  • Occupational Risk Prevention
  • Development
  • Internal Communications
  • Corporate Social Responsibility (CSR)

The Recruitment Process

Recruitment is the process of searching for the candidate who best fits a profile corresponding to a specific job post. It consists of three essential stages:

  1. Analysis of staffing requirements
  2. Job selection
  3. Hiring (Formalization)

Hiring Formalization and Contract Selection

The formalization of hiring consists of three stages: choosing the type of contract, formalizing the agreement, and affiliation/registration (high) in the Social Security (SS) system.

Choosing the Appropriate Contract Type

When selecting the most appropriate type of contract, different variables must be taken into account:

  • Cause of Relationship: To determine the basis of the employment relationship, the characteristics of the job and the worker must be assessed.
  • Conditions and Constraints: Other constraints influence the choice of contract type, such as the cost of dismissal, and possible incentives and bonuses received by the employer.

The Employment Contract

An employment contract is an agreement between two persons where one, the worker, agrees to provide certain services under the direction of the other, the employer, receiving remuneration in return. The agreement can be formalized:

  • Verbally: Applicable to regular permanent contracts and fixed-term contracts for lower production circumstances (up to 4 weeks full time).
  • In Writing: Required for all other types of contracts.

The signing of an employment contract establishes a number of rights for workers, which in turn are obligations for the employer, and vice versa.

Types of Indefinite Contracts

Regular Indefinite Contract

This is the standard full-time or part-time permanent contract mode.

  • Characteristics: Permanent status, full-time or part-time. While often written, there is no strict verbal/written requirement for this specific mode.

Indefinite Contract for the Promotion of Permanent Employment

This indefinite contract is designed to facilitate the stable placement of unemployed workers and employees currently subject to temporary contracts.

Requirements for Workers:

  • Unemployed workers meeting specific criteria (e.g., young people 16–30 years old, unemployed women aged 45+, long-term unemployed (6 months), people with disabilities).
  • Workers who, on the date of conclusion of the new contract, were employed in the same enterprise through a fixed-term or temporary basis (including training contracts concluded before December 31, 2007).

Formalities and Incentives:

  • Formal Model: Must be indefinite and written using a formal model.
  • Incentive (Severance): If the contract is terminated for objective reasons and declared inadmissible (unfair dismissal), the allowance shall be 33 days per year of service, up to a maximum of 24 monthly payments.

Company Restriction: The company must not have carried out objective dismissals, judicial dismissals, or collective redundancies within the 6 months prior to the conclusion of these contracts.

Temporary Contracts

Contract for Specific Work or Service

This contract type is intended for performing specific works or services related to the company's activity. Its execution, although limited in time, is of uncertain duration.
