Administrative Procedure Termination and Withdrawal Rules
Termination of Administrative Procedures
T. The administration shall stop the procedure upon withdrawal or waiver of the application, provided such waiver is not prohibited by law. Termination may also occur due to the physical impossibility of continuing the proceedings. In all cases, a formal resolution must be issued.
Resolution Requirements
R1. The administration must decide all questions raised by interested parties. Resolutions must be consistent with the requests made, without aggravating the applicant's initial position. The administration reserves the right to initiate a new procedure automatically.
The administration cannot refuse to address a case due to silence, obscurity, or insufficient legal requirements. However, it may reject applications for rights not foreseen by law or those that are manifestly unfounded.
Withdrawal and Waiver of Rights
DR. An applicant may withdraw their application or waive their rights, provided it is not prohibited by national law. If multiple parties are involved, the withdrawal or waiver only affects those who explicitly requested it. These actions may be performed by any means capable of being recorded.
The administration shall accept the withdrawal or resignation and close the proceedings, unless third parties involved urge the continuation of the process within ten days of notification.
Expiration and Paralysis
C. In proceedings initiated at the request of an interested party, if the process is paralyzed for causes attributable to the applicant, the administration shall warn them that the procedure will expire after three months. Upon expiration, the administration will archive the file and notify the interested party. No appeals may be filed against this expiration.
Expiration does not produce the prescription of particular actions, nor does it interrupt the statute of limitations. Expiration shall not apply if the case concerns general interest or if clarification is necessary for the public good.
Mandatory Motivation
IMP: All administrative resolutions must be properly motivated and documented.
