Rule of Law: Requirements and Features

According to Article 16 of the Declaration of the Rights of Man and of the Citizen (DDHC): "A society in which the guarantee of rights is not assured, nor the separation of powers determined, has no constitution."

On this historical basis, we can analyze the requirements of the rule of law. Professor Elias Diaz, in his famous book, "Democratic Society and Rule of Law," outlines four of these requirements:

1. Rule of Law

The rule of law replaces the rule of men with the government of laws. This is a consequence of the desire to "depersonalize" the exercise of political power. As a government of laws, it follows that all public authorities, not only citizens, are subject to the law. It is not just any kind of...

Confederation vs. Federal State: Legal and Structural Differences

Law2.89 KB

Confederation of States: Definition and Structure

Concept of a Confederation

According to García Pelayo, a Confederation is the relationship between States, created by an international agreement, with the intention of perpetuity, which leads to a power that is exerted on Member States and not, immediately, on individuals.

Legal Nature and Historical Context

From a historical point of view, the Confederation has a fluid nature, often seen as a mere alliance between a League and a Federal State. In any case, it belongs primarily to international law, since it holds no immediate power over the citizens of each State. When in doubt, the competition and the law of the particular state prevail.

Constitutional scholars are interested in its study for...

Constitution, Legislative Roles and Fundamental Rights

Law3.49 KB

Constitution

Constitution: The fundamental rule, written or otherwise, of a sovereign state, established or accepted to govern it. The constitution sets limits and defines the relationship between state powers (powers that, in modern Western countries, are defined as legislative, executive and judicial) and between them and their citizens, thus establishing the basis for government and the organization of the institutions in which such powers are based. It also guarantees rights and freedoms to the people.

Deputy and Senator

Deputy: A deputy is a member of a Chamber of Deputies, House of Representatives, or, in general, a parliament. We refer to the lower house as the Chamber of Deputies, while the Senate is composed of senators. Deputies have...

Spain's Autonomous State and Andalusian Decentralization

Law2.51 KB

The Decentralization of the Spanish State

From the start of the transition, it was necessary to respond to the demands for autonomy that had been requested during the Franco era. The King spoke of this in his inauguration, and the Constitution contemplated that possibility. The process was not simple: there was unanimity for the historical nationalities; however, there was no unanimity regarding whether to spread this throughout the territory or what the competencies should be.

The demonstrations in favor of autonomy led the government to generalize the process, which caused many tensions among those faithful to Francoism. In 1979, the statutes of Catalonia and the Basque Country began the configuration process of the autonomous state. In the...
