Understanding Public Levies and Fees

Fees are payments made in exchange for the immediate provision of a service or the realization of a specific activity. Unlike other levies, they are directly linked to a service provided to the payer.

Special contributions are derived from obtaining a benefit or an increase in the value of property as a direct result of public works or the establishment and expansion of public services.

Direct and Indirect Taxation Systems

Taxes are levies that require no immediate or direct consideration by the administration. They are categorized into two main types:

  • Direct taxes are levied on personal and economic capacity.
  • Indirect taxes are levied on the taxpayer's economic capacity when it is reflected through consumption.

Municipal and Corporate Tax Obligations

Municipal taxes include the Tax on Economic Activities (IAE), Real Estate Tax, Motor Vehicle Tax, Tax on Construction, Installations, and Works, and the Tax on the Increase in Value of Urban Land.

Corporation tax is a direct and personal tax levied on the income of corporations and other legal entities. It is generally determined by applying a tax rate of 35% to the accounting profit, which is calculated in accordance with the rules laid down in the Code of Commerce.

Personal Income Tax and VAT Rates

Personal Income Tax (PIT) is a direct and personal levy on the income of natural persons, adjusted according to their personal and family circumstances. It is determined based on:

  • Earned income
  • Capital gains or movable property income
  • Profits and losses

It is a progressive tax, meaning that the tax rate is higher as the tax base increases.

Value Added Tax (VAT) is an indirect tax levied on the consumption of goods and services within Spanish territory. It applies to the total amount of the purchase or provision of services, including other figures in the bill as determined by law. Currently, there are three tax rates: a general rate of 16%, a reduced rate of 7%, and a super-reduced rate of 4%.

Steps to Calculate Total Tax Liability

To calculate tax liability, one must complete these specific steps:

  1. Determining the base: This consists of all taxable income.
  2. Calculating taxable income: This is the result of subtracting different applicable concepts.
  3. Determining tax liability: This is the result of applying the specific tax rate to the tax base.
  4. Determining the amount settled: This is the sum of state and regional quotas.
  5. Calculating the differential fee: This is the final result after subtracting deductions from the liquid share.
