Spanish Property Valuation Methods and Economic Activities Tax (IAE)
Property Assessment Methods in Spain (6)
The property value consists of land value and building value, regulated by Royal Decree 1020/1993 on the valuation of urban property.
Calculating Land Value Impact: Residual Method
The basic land value impact is obtained using the residual method. This method is based on the value of the real estate product, from which the full value of the building is subtracted. This resulting value is measured in euros per square meter (€/m²) of construction.
Since these assessments are referenced to a square meter of construction, the land value impact is essentially a ratio derived from the land value and the volume of construction, expressed per square meter of construction.
Determining Building Value: Replacement Cost Method
The building value is determined using the replacement cost method. This involves finding the current cost based on the cost of executing the work—i.e., what it would cost to reproduce the building using current technology and current prices for materials and labor. This value is measured in euros per square meter (€/m²).
Calculation Example: Residual Land Value
Assumptions:
- Property Price: 3,000 €
- Total Construction Price: 1,000 €
- Construction Area: 10 m²
Calculations:
- Share selling price per m² of construction: 3,000 € / 10 m² = 300 €/m² construction.
- Price of square meter of construction: 1,000 € / 10 m² = 100 €/m² of construction.
- Impact land value (Residual): 300 €/m² - 100 €/m² = 200 €/m² residual construction.
- Total land value: 200 €/m² x 10 m² = 2,000 €.
The ratio of Land Value to Construction Area is 2,000 € / 10 m² = 200.
Tax on Economic Activities (IAE) in Spain (II)
Its regulation is found in the Law on Local Finance (Revised Text 2004).
Taxable Event and Taxpayer (1)
The taxable event is the exercise of a business, professional, or artistic activity within a municipality in Spanish territory.
Specific activities included are:
- Industrial activities
- Commercial activities
- Services sector activities
Activities generally excluded from the tax include those in the primary sector: farming, fishing, and forestry.
The taxpayer is the entity or individual performing the taxable event. This can be an individual, a legal person, or an entity without legal personality (such as community property). Therefore, the taxpayer is anyone who carries out an economic activity, although there is a significant exemption that applies.
Accrual and Tax Period (2)
As a rule, the tax period corresponds to the calendar year. The accrual occurs on the first day of the period, i.e., January 1st.
If the activity starts (high), the quota must be apportioned by calendar quarters. If the activity ceases (low), the quota must also be apportioned by calendar quarters, and consequently, a refund of the corresponding fee may be requested.
