Labor Regulations and Employee Compensation Standards
Salary and Compensation
Salary is the total economic benefit received by workers in cash or in kind for providing their services. Paid employment in kind may not exceed 30% of employee perceptions. The Minimum Interprofessional Wage (SMI) is the wage fixing established by the Government in accordance with ILO Convention 117.
Composition of Wages
The salary consists of base pay, which is pay fixed per unit of time or work, and wage supplements fixed by convention. Workers are also entitled to extraordinary pay, typically consisting of two payments as determined by group agreement.
Wage Guarantees and Payroll
Regarding the guarantee of wages, the wages of workers have priority over other debts. The payroll (nómina) is the individual receipt and proof of payment of the wages given to the employee in settlement of their services.
The main parts of a payroll include:
- Header: Identification data.
- Accruals: Gross pay.
- Bases of Social Security contributions: Amounts determined according to the remuneration received by the worker (BCCC, BCCP, BHE).
- Deductions.
- Total to be charged: The difference between the total due (total gross wages) and deductions. This result is the net salary or liquid pay.
Worker Rights and Duties
Rights: These include weekly closing (rest), annual leave, and non-discrimination.
Duties: Concrete tasks, health and safety compliance, contributing to improving productivity, and delivering the fruits of their labor.
Unions and Collective Bargaining
A union is an association of workers defending their common interests and claims regarding the economic and social policies of its members. In 1985, the Organic Law on Freedom of Association was created. Within a company, representation is handled by staff delegates and works councils.
Collective bargaining is the process of achieving an agreement between workers and employers on the conditions under which activity will develop in a workplace, enterprise, or enterprise group. A Collective Bargaining Agreement is a contract negotiated by workers and employers for the regulation of working conditions.
Labor Conflict and Competency Management
A labor conflict occurs when the company and workers disagree on some aspect of the employment relationship, such as collective disputes, strikes, or temporary closures.
Management by competencies is the way some companies manage their staff so that the job a person deals with involves a wide range of skills to meet any business situation.
